Thank you for your letter of the 29th July containing the findings and The Local Government Ombudsman’s decisions. Whilst I have not replied to you directly I’m sure you are aware that I am less than happy with the outcome. I’m sure you could go to my Croydon Council GUILTY web site to get the gist of that.
There are a number of discrepancies I wish to make known and really believe they should be considered complaints against The LGO. (nothing personal you understand, just the rotten corrupt system you have to operate under)
First of all I notice a number of complaints and findings against various Councils are reported on your web site, but not my own complaint . . . can I ask if my case is to be reported or not?

Findings of maladministration and injustice
East Lindsey District Council (04/C/12529)
Building control . . . ‘Mr and Mrs Lee’ (not their real names) had a bungalow built in 1989. The floors began to collapse in 2002. The Council had carried out inspections under the building regulations but had failed to notice that airbricks of half the specified size had been installed. As a result, condensation had built up in the floor space and the joists supporting the new wooden floor had rotted.
The Ombudsman found maladministration in the Council’s failure to observe that the wrong airbricks had been installed which were therefore in contravention of the building regulations. She recommended that the Council meet one third of the reasonable costs of reconstruction, including professional fees and alternative accommodation while the works were underway. In taking this approach the Ombudsman said: “I am mindful that the Council was not the only agency involved; both Mr and Mrs Lee and their builder were partially responsible for ensuring that the property was properly contracted.” The Council agreed to this recommendation and Mrs Thomas commended it for its readiness to settle this complaint.
But the Ombudsman also said, “I have a particular sympathy with Mr and Mrs Lee when they say that they were under a complete misapprehension as to the degree of protection afforded them by the building control system.” So, in addition, the Ombudsman recommended that the Council should consider issuing a statement to future applicants for building regulations approval, describing the building control procedure and its legal implications.

I wonder if you can see where I am going with this?
Mr Redmond: . . . . . We judge what is fair by actually taking the complaint that is put before us, we examine the complaint and we look at the key concerns of the complainant. We then take the information, we look at the council's response, We look at the council's records, we may interview a series of people, we form a judgment and that judgment is based on all the information and evidence that we need in order to make that judgment and that is an equitable way of carrying out the investigation which leads to a fair judgment.
My original complaint against Croydon Council . . (others of course transpired as the depth of Croydon Council’s inadequacies became more and more apparent . . the Flue being the most obvious manifestation) . . . . was . . . that the soundproofing under my floor was installed recklessly, no doubt with the connivance of the same ‘knowledgeable officers’ as Phillip Goodwin Planning Director refers to them . . that connived to let the Flue be installed. That as you know had to be so unceremoniously and ignominiously removed from my property, because of that . . . . . . . . . . . . . . . . . in fact ‘LACK OF KNOWLEDGE’.
A great deal of that recklessness is caused by, but by no means confined to, the fact that NO AIR BRICKS were recommended, asked for, or even considered in the installation of this monstrosity.
MY COMPLAINT was and still is that no proper consideration was made, and no reasonable steps have been taken, to avoid exactly the same CATASTROPHE as befell Mr and Mrs Lee in your finding of 7th June 2005.
So my question is . . . have I got to wait till MY floors cave in before I can complain to The Local Government Ombudsman about Croydon Council ignoring the most basic of building requirements?
Please take this as a complaint against your findings. . . . if you can see a more bizarre piece of reasoning would you point it out to me?
I wish to point out that LGO have NOT “taken the complaint that is put before us” . . you have ruled however that Croydon Council took an inordinate length of time to sort out just one of my concerns . . . whilst totally ignoring the others. . . that complaint only transpired in the fullness of time . . . . . . .a dammed full long time

Maladministration is not the same as illegality; it has a potentially wider application. An action taken by a council might be legal but might be unfair or CONTRARY TO GOOD PRACTICE, in which case it can be considered to be maladministration.

When a door fell off its hinges we didn't think we had much of a problem. You get used to such things with an old building. But when Jessie, our carpenter, came to repair the door frame, she looked serious. "Looks like dry rot to me, " she said. "You'd better call in an expert."
Serpula Lacrymans
Her diagnosis was all too accurate. It turned out that we had one of the most extensive cases of True Dry Rot fungus, serpula lacrymans, that the contractor had dealt with in a long time. Dry rot spores are in the atmosphere all the time, just waiting for the right conditions to get them going. They need damp, wood, warmth, and an absence of ventilation. We provided those spores with Paradise! We had blocked down pipes and drains, which gave a plentiful supply of dampness. We had bushes hard against the church wall outside cutting off ventilation, and a warm-air heating duct running along the inside of the wall. Once the fungus has got a hold, it no longer needs any special conditions; it will happily send its fibrous tendrils through wood, plaster, brick - anything, gobbling up any cellulose it can find on the way. This leaves wood looking sound, but utterly devoid of any solidity. We found that a roof truss was fatally weakened, and the building was declared unsafe for a while, until it could be repaired. But the damage was much more than that: one long side wall was almost completely affected, rafter ends needed replacing, two toilets were so full of dry rot they had to be completely stripped - and still we haven't told all the tale. But you will have got the picture of the crippling extent of the damage. And the trouble with dry rot is you can't just leave it: it marches relentlessly on every day, like some alien taking over the planet! . . .

We decided the best thing to do was to pull the whole building down and rebuild:
