In April 2004 Generalisimo Welsher head of the Banana Republic of Croydonia asks his 2nd in command Dr No’enquiry (Alias Phil Goodwin Director of Pig Launching and Planning) to “undertake a thorough review regarding events at the above property.”  . . . His conclusion is given in a letter of the 29th April 2004 . . . . . . . “I think I understand your problems. However. I do not feel we have in any way been negligent. Indeed I would like to think you could see the sense of what I have said about the sound-proofing and rest somewhat easier as a result.”
(So much easier now an expert like you Phillip has reassured me . . Colin)

My original complaints against Croydon Council . . (and they didn’t even start off as complaints) . . were letters of information . . basically . . do you realise what these people are doing.? . . . I did have issue with the fact that LBC had not informed us of the Planning Application . And that they had given Planning Permission to a shop that had to use my doorway in order to have a suitable access and fire exit. But most of all I complained about the soundproofing called for by the new Soundproofing Act July 2003. This requires shops of this kind  . . to in effect . .  build a whole new structure inside the premises. A shop within a shop as it were. The problem is,  the soundproofing is cheap fiber-glass, and there is no ventilation or air flow between the sub-floors whatsoever.
This isn’t rocket science.  The Romans knew  of these principles. If there is a possibility of damp you need to  VENTILATE IT. It’s what air-bricks are for. All houses have them. Its what ventilation holes in the soffits are for. Its what ventilation mushrooms in flat roofs are for. It’s what all building regulations call for . . except in CROYDON.
Worse,  this structure is under our kitchen, washing machine, bathroom and toilet. If any of that leaks as has happened many times in the past  . . (even before we owned it) . . . there is nowhere for the water to go. It will sit in the fibreglass forever or until it is absorbed by my 100 year old floors that have managed very nicely up till now.
I made so much fuss about their ignorance on the matter that David Wechsler the Chief Executive appointed Phillip Goodwin  Director of Planning to “undertake a thorough review regarding events at the above property.”
His conclusions are given in a letter of the 29th April 2004.
 “The plans did not show any subdivision of ownership of the access and no queries in that respect were received.” . . . That turned out to be because a) the plans were deliberately falsified by the applicant to show my property as his.  b) because we were not informed of the Planning Application at the outset as required by law, and therefore were not able to “query” it.. but worse c) even when LBC were informed of it they just ignored the matter from then on. . . . Goodwin’s  excuse for not contacting us about this trivial matter is that they send out 40,000  notification letters every year and they can’t be expected to contact everyone.
NOT TO FLATS ABOVE TAKE-AWAYS YOU DON’T MR GOODWIN, you only do a dozen a year.  
A year later we find “that this address was omitted from the original list.” . . . OMITTED FROM THE LIST? They send to 9 adjacent properties but not the one upstairs? And Phillip Goodwin reports ,“I do not feel we have in any way been negligent”
On the matter of the soundproofing the report goes on “I would like to offer the view of my experienced and knowledgeable officers which is this.” . . . In précis.
“The scenario you describe, of a small but persistent leak soaking the underfloor insulation, is quite feasible. It is far more likely that the ceiling of the shop would become damp. Even if ignored the more likely result would be that the ceiling would fall down. Long before dry rot should become  established on what are treated timbers.”
(So that’s the new policy in CROYDON. Don’t worry about damp. Wait till the ceilings fall down)

KNOWLEDGEABLE OFFICERS PHILLIP ??? Are they the same “knowledgeable officers” that don’t know that Local Authorities  are responsible for the GAS regulations? Are they the same “knowledgeable officers” that passed an extraction flue as being perfectly acceptable . . . but when properly investigated turned out to be “not in any way that approved.”? Are they the same “knowledgeable officers” that signed a completion certificate FREE OF CHARGE for a flue that on proper inspection is found to still be a nuisance 18 months later? Are they the same “knowledgeable officers”  that gave the shop PERMISSION TO PUT IT ON OUR PROPERTY?
Are they the same officers that know nothing about fire risk in extractor flues as described by the London Fire Brigade? Are they the same officers that can’t tell the difference between
a Fish and Chips, Chinese Food to Take Away and a flower shop from twenty paces?
THEIR IGNORANCE OF BUILDING MATTERS MR GOODWIN IS MATCHED ONLY BY THE CALLOUS INDIFFERENCE OF YOU AND YOUR BOSS DAVID WECHSLER CEO.
YOU ARE BOTH A DISGRACE TO YOUR PROFESSION  AND SHOULD BE SACKED.

Or go to http://www.diydata.com/problem/timberrot/timberrot.htm and find out  what AIRBRICKS are for. . . . . “There is not much you can do to prevent dry rot apart from making sure that the conditions it requires  to grow are not present. Check that all air bricks are unobstructed and additional air bricks can be added to increase under-floor ventilation. Check all timber whenever you have the chance (i.e. when lifting a floorboard for any reason) to ensure that no timber becomes wet. (Unless you live in CROYDON.
Then it’s best to wait until the ceilings fall down.)

· THE LIE
We aim to:-   Provide help and advice on any matter related to a Building Regulation application prior to and during the deposit of plans with the Council.  
Not just reject your plans if they don't comply, but provide you with a schedule listing the items of non-compliance within fifteen working days.  
On 'relevant' premises, act as a 'One Stop Shop' in relation to fire precautions by consulting the Fire Authority about your application.
After satisfactory completion of a job on site, automatically issue a completion certificate FREE OF CHARGE.
Provide a written response to customer complaints, giving a full explanation and detailing action to be taken as appropriate, within ten working days.·
Liaise with other Council services affected by your project.

Findings of maladministration and injustice

Building control
‘Mr and Mrs Lee’ (not their real names) had a bungalow built in 1989. The floors began to collapse in 2002. The Council had carried out inspections under the building regulations but had failed to notice that airbricks of half the specified size had been installed. As a result, condensation had built up in the floor space and the joists supporting the new wooden floor had rotted.
The Ombudsman found maladministration in the Council’s failure to observe that the wrong airbricks had been installed which were therefore in contravention of the building regulations. She recommended that the Council meet one third of the reasonable costs of reconstruction, including professional fees and alternative accommodation while the works were underway. In taking this approach the Ombudsman said: “I am mindful that the Council was not the only agency involved; both Mr and Mrs Lee and their builder were partially responsible for ensuring that the property was properly contracted.” The Council agreed to this recommendation and Mrs Thomas commended it for its readiness to settle this complaint.
But the Ombudsman also said, “I have a particular sympathy with Mr and Mrs Lee when they say that they were under a complete misapprehension as to the degree of protection afforded them by the building control system.” So, in addition, the Ombudsman recommended that the Council should consider issuing a statement to future applicants for building regulations approval, describing the building control procedure and its legal implications.

But it gets sillier than that . . . . Here is a very recent finding by The Local Government Ombudsman and on their own web-site we find  that they have found against East Lindsey District Council the following.
Well excuse me for being cynical . . But Mr and Mrs Lee  should consider themselves lucky (irony) that they had air bricks that were only half the size . . . . I WOULD LIKE TO HAVE SOME AT ALL. . . letter to The LGO to that effect.
